Practice Pointer: Converting from L-1B to L-1A Status

The Vermont Service Center (VSC) recently issued a practice pointer on cases requesting a conversion from L-1B specialized knowledge to L-1A manager/executive status.  Please note the following tips by the VSC:

The Vermont Service Center (VSC) recently issued a practice pointer on cases requesting a conversion from L-1B specialized knowledge to L-1A manager/executive status.  Please note the following tips by the VSC:

  • A $500 fraud fee is not required since the VSC considers this a change in the conditions of employment rather than a ‘change of status’.
  • If you are requesting an extension of stay, Part 2.2 of Form I-129 should be checked ‘c’ – “change in previously approved employment.  Also, Part 5 should be checked ’c’ – “extend the stay of the person(s) since they now hold this status.” 
  • If you are not requesting an extension of time, Part 2.2. of Form I-129 should checked ‘c’ and Part 5 should be checked ’d’, which is “amend the stay of the person(s) since they now hold this status.”
