H-2B Cap Reached for Workers Returning in Early Second Half of FY 2025


The H-2B visa cap has been reached for temporary non-agricultural workers starting employment between April 1, 2025 and May 14, 2025.

The H-2B visa is a temporary work visa which allows foreign nationals to work in the United States for a limited time in nonagricultural field. The annual H-2B visa cap is set at 66,000 divided equally between the first and second half of the fiscal year (although unused numbers from the first half of the fiscal year may carry over into the second half).

The Department of Homeland Security and the Department of Labor released a temporary final rule on December 2, 2025, increasing the H-2B visa cap. For workers returning in the early second half of the 2025 fiscal year, an additional 19,000 H-2B visas were made available (reaching a total of up to 64,716 for the entire fiscal year), and enough petitions have now been received to reach the cap.
