Under the Federal government shutdown, U.S. Department of Labor (DOL) employees have been placed in “furlough status.” As a result, the Department of Labor (DOL) has stopped all processing as specified below.
The DOL will not accept nor process any applications it receives, including H-1B Labor Condition Applications, Applications for Prevailing Wage Determination, Applications for Temporary Employment Certification, or PERM Applications for Permanent Employment Certification. This will continue until Congress and the President reach a continuing resolution deal to fund the government.
As you can imagine, this is creating quite a few problems for companies wanting to file H-1B cases or PERM Labor Certifications on behalf its employees or potential hires. Hopefully, our politicians will resolve this impasse in Washington, D.C. soon.
