Asylum

If you are physically present in the United States and have a fear of being persecuted in your home country, you may qualify for asylum, regardless of how you entered the country or your current immigration status.  If granted, asylum would allow you to remain in the United States without fear of removal or deportation to your home country, due to Federal and International protections you receive.

You can file for asylum both affirmatively or defensively.  You can file affirmatively if you are in lawful status, or are not in removal (deportation) proceedings, and you can file defensively if you have already been placed into removal proceedings.
