An I-601 wavier is used to waive certain grounds of inadmissibility which render a foreign national ineligible to obtain Lawful Permanent Resident status in the United States.
For example, a foreign national will trigger a 10 year bar to reentering the United States if he or she departs the US after accruing 1 year or more of “unlawful presence.”
Often these foreign nationals are readmitted to the US even though they have triggered a 10 year bar to reentry. The issue comes up at the green card interview when the officer finds the foreign national “inadmissible” and requests an I-601 wavier application to waive the 10 year bar. Other grounds of inadmissibility include committing fraud to enter the US and criminal violations.
This seminar will not focus on specific grounds of inadmissibility. Rather, we will discuss the procedures involved in filing an I-601 waiver application, the legal standards, and the most effective types of supporting evidence.
