USCIS Ordered to Accept New DACA Applications


A federal court judge in Maryland ordered on Friday, July 17, 2020 that USCIS must resume accepting initial Deferred Action for Childhood Arrivals (DACA) applications. This comes after almost 3 years during which time initial DACA applications were not accepted by USCIS per an order by the Trump Administration to rescind the benefit. Meaning that if you had not filed for initial DACA prior to September 5, 2017, you were ineligible to apply from then on.

This order also comes after the Supreme Court decision striking down the Trump Administration’s attempt to terminate the DACA program. After which USCIS issued a statement that it was disregarding the decision by the Supreme Court as “it had no basis in law”.

USCIS must now accept initial DACA applications.
