Based on the January 20, 2025, Executive Order “Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government,” the U.S. Department of State announced that passports and birth certificates are required to display the same sex marker.
This means that the government will no longer issue passports whose sex marker is different from what is on an individual’s birth certificate or issue passports with the X marker. The X marker was added in 2022 and allowed individuals to refrain from choosing “F” or “M” as the gender identified on their passport.
Valid passports with the X marker or whose sex marker doesn’t match the individual’s birth certificate (assigned prior to the January 20 order) will be accepted until their expiration. Those with X markers on their passport or who have sex marker inconsistencies between their passport and birth certificate may also choose to replace their passport, using Form DS-5504 or Form DS-82 depending on when the original passport was issued.
