The U.S. Department of State (DOS) released its November 2014 Visa Bulletin. The Visa Bulletin sets forth per country priority dates that regulate the ability of an individual to file an adjustment of status application or consular process at a U.S. Embassy. Foreign nationals can file an adjustment of status application if their priority dates are prior to the cutoff dates specified by the DOS in the Visa Bulletin.

Unfortunately for Indian nationals, EB-2 retrogressed to February 2005. That is a major backward retrogression in a category that had moved forward considerably in recent months, thus allowing thousands of Indian nationals to file their I-485 Adjustment of Status applications.  A major factor in this anticipated retrogression is the large volume of EB-3 to EB-2 upgrades for Indian-born applicants.

Visa availability and cutoff dates are determined on a monthly basis by the DOS based on anticipated demand.   These dates can move forward, backward or remain unchanged. Employers and employees should monitor the monthly Visa Bulletins so they can properly plan their immigration cases.
