Texas Court Stalls President Obama’s Deferred Action Program

Late Monday, U.S. District Court Judge Andew Hanen in Texas barred the Obama administration from going forward with plans for a major expansion of the deferred action program, including the new deferred action for parents of US Citizens and Lawful Permanent Residents.

Late Monday, U.S. District Court Judge Andew Hanen in Texas barred the Obama administration from going forward with plans for a major expansion of the deferred action program, including the new deferred action for parents of US Citizens and Lawful Permanent Residents.

In his ruling, Judge Hanen wrote, “DHS does have discretion in the manner in which it chooses to fulfill the expressed will of Congress. It cannot, however, enact a program in which it not only ignores the dictates of Congress, but actively acts to thwart them. DHS Secretary [Jeh Johnson] is not just rewriting the laws he is creating them from scratch.”

The White House said that the Justice Department will appeal Judge Hanen’s decision.
