How Far Ahead of October 1st Can I Apply For an H-1B Visa?

admin

If you have an approved H-1B petition with an October 1st, 2014 start date, you can actually APPLY FOR an H-1B visa now. Consular offices are authorized to accept H-1B visa applications and issue the visas up to 90 days prior to the start date on the H-1B petition. However, it’s important to note that an H-1B visa holder can only use that visa to enter the U.S. in H-1B status up to 10 days prior to the October 1st, 2014 start date. So, although you can beat the rush in getting a visa stamp, you cannot enter the US until late September.
