Et, tu, DHS? Gov’t Revises October 2015 Visa Bulletin

On Sept. 25, the Department of State (DOS) published an updated October 2015 Visa Bulletin. This bulletin supersedes the bulletin for October 2015 that was originally published on Sept. 9, 2015.  The Dates for Filing Applications sections on pages 4 and 6, which have been adjusted, have been identified in bold type and highlighted.

On Sept. 25, the Department of State (DOS) published an updated October 2015 Visa Bulletin. This bulletin supersedes the bulletin for October 2015 that was originally published on Sept. 9, 2015.  The Dates for Filing Applications sections on pages 4 and 6, which have been adjusted, have been identified in bold type and highlighted.

Applicants should use the chart published by DOS on Sept. 25 when filing for adjustment of status. Please be advised that DHS will rely on this revised bulletin rather than the bulletin published on Sept. 9, 2015, when considering whether an individual is eligible to file his or her application for adjustment of status.

What does this mean?  It means that thousands of intending immigrants who have been preparing I-485 applications, paying for medical exams, and looking forward to receiving employment authorization/travel documents, must now wait yet again for their turn in line. 

For EB-2 India, if your priority date isn’t prior to July 1, 2009, DO NOT file your I-485 cases in October.

This is obviously a new program by DHS/DOS.  However, we find it disturbing that they can revise an already published Visa Bulletin.  If these bulletins can be revised at whim by DHS/DOS, how can intending immigrants rely on the published ‘Date of Filing Application’ dates and plan their cases with some level of certainty?  The answer is, they can’t.
